Terms of Service

Terms governing creators, buyers, visitors, subscriptions, AI tools, storefronts, and transactions on Pluff

Please read this document carefully. It contains important provisions concerning recurring charges, creator responsibilities, AI-assisted content, payment processing, liability, and dispute resolution.

1. Agreement and Scope

These Terms of Service are a binding agreement between you and Pluff ("Pluff," "we," "us," or "our"). They govern access to and use of pluff.social, Pluff creator accounts, public storefronts, hosted challenges, interactive guides, workbooks, customer access areas, AI-assisted creation tools, payment-related features, and any related applications or services that link to these Terms (collectively, the "Service").

By creating an account, starting a trial, purchasing a subscription, connecting a payment account, publishing content, buying a creator product, or otherwise using the Service, you agree to these Terms and the Pluff Privacy Policy. If you use Pluff on behalf of a company or organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

Additional terms shown during checkout, creator onboarding, a product purchase, an AI generation, a promotion, or the use of a particular feature form part of this agreement. If additional terms conflict with these Terms, the additional terms control only for that specific feature or transaction.

2. Eligibility and Where Pluff Is Offered

Creator accounts are intended only for individuals who are at least 18 years old, are legally capable of entering a contract, and are located in the United States or another country where Pluff offers payouts (the countries are listed when you connect your bank). A creator acting for a business must have authority to act for that business. Pluff may require identity, age, tax, business, banking, or other verification before enabling sales or payouts.

The Service is not directed to children under 13. A buyer under the age of majority may use the Service only with the involvement and permission of a parent or legal guardian. Creators may not knowingly market restricted or age-inappropriate products to minors through Pluff.

Pluff is offered in the United States and in the other countries where Creators can connect a payout account through Stripe. Prices on Pluff are in US dollars; when a Creator's bank account is in another currency, Stripe converts payouts and may charge a currency-conversion fee. We do not represent that every feature, product, payment method, payout method, or legal framework is available or appropriate in every location. You are responsible for complying with the laws that apply to you, including any taxes on your sales where you live.

3. Definitions

"Creator" means a person or business using Pluff to create, publish, promote, sell, license, or deliver products or services. "Buyer" means a person who views, registers for, purchases, or accesses a Creator Product. "Creator Product" means any challenge, interactive guide, workbook, downloadable file, digital resource, service, booking, membership, or other offering made available by a Creator through Pluff.

"Creator Content" means prompts, text, images, recordings, branding, files, data, product materials, testimonials, links, and other content submitted or published by a Creator. "AI Output" means content or recommendations produced through an AI-assisted feature. "Platform Fee" means the percentage or fixed amount Pluff deducts or collects from a Creator transaction. "Payment Processor" means Stripe or another authorized third-party payment provider.

4. The Role of Pluff

Pluff provides technology that helps Creators build and host products, operate link-in-bio storefronts, accept payments through connected payment accounts, and deliver products to Buyers. Unless Pluff expressly states otherwise, each Creator is the seller, service provider, and licensor responsible for that Creator's products and customer relationships. The settlement merchant and statement descriptor for a payment are determined by the applicable Stripe Connect configuration. Pluff is not the author, publisher, instructor, health professional, financial adviser, employer, agent, partner, joint venturer, or guarantor of any Creator.

Buyer payments for Creator Products are processed using Stripe Connect direct charges. Stripe processes each payment directly on the Creator's connected Stripe account, with the Creator as the merchant, and Pluff collects its Platform Fee from each payment as an application fee. The Creator's business name or statement descriptor ordinarily appears on the Buyer's card or bank statement. The Creator is the seller or service provider for the underlying Creator Product and is responsible for its description, price, promises, refund policy, legal compliance, and fitness, subject to these Terms and Pluff's platform rules.

Pluff may assist with customer support, delivery, disputes, moderation, or refunds, but doing so does not make Pluff the seller of a Creator Product or create an agency, employment, fiduciary, or partnership relationship.

5. Accounts and Security

You must provide accurate, complete, and current information and keep it updated. You may maintain only the number of accounts Pluff permits. You may not impersonate another person, misrepresent ownership of a brand, conceal the true operator of a storefront, or transfer an account without Pluff's written approval.

You are responsible for account credentials, passkeys, multifactor authentication, authorized team members, and activity occurring through your account. Notify support@pluff.social promptly if you suspect unauthorized access. Pluff may treat instructions from an authenticated account as authorized, but may require additional verification before sensitive changes, payouts, exports, or account recovery.

Team access, if offered, must be assigned to identifiable individuals. Creators are responsible for acts and omissions of collaborators, contractors, employees, and agents given access to their account.

6. Creator Onboarding and Stripe Connected Accounts

To accept live payments, a Creator must establish and maintain an eligible connected account with Stripe. Stripe may collect legal name, date of birth, tax identification, business, ownership, banking, identity, and other information required for know-your-customer, anti-money-laundering, sanctions, fraud, and payment-network obligations. Stripe's agreements and privacy policy apply separately to the Creator's use of Stripe.

Pluff does not control Stripe's underwriting, verification, reserve, payout, account restriction, or termination decisions. A Creator must promptly complete requests from Stripe or Pluff. Payment acceptance may remain disabled until verification is complete. Pluff is not responsible for delays or losses caused by inaccurate information, failed verification, a processor restriction, or the Creator's violation of processor rules.

Creators authorize Pluff and Stripe to create charges on the Creator's connected account, collect Platform Fees as application fees, issue or facilitate refunds, receive transaction and account-status information, and take other actions reasonably necessary to operate Pluff's payment features. A Creator may not bypass Pluff's fee collection or manipulate transaction routing to avoid fees.

7. Creator Subscriptions and Automatic Renewal

Paid creator plans renew automatically at the monthly or annual interval selected during checkout until cancelled. By starting a free trial or a paid plan (a trial, and a plan chosen during a trial, is first charged when the trial ends), you authorize Pluff and its Payment Processor to charge the applicable subscription price, taxes, and disclosed fees to your saved payment method when due without obtaining separate permission for each recurring charge.

Changing plans. During a free trial, a Creator may switch plans or billing cycles in Settings → Billing at no charge: the trial keeps its end date and its AI Credits, and the payment method is charged for the plan and billing cycle in place when the trial ends. Choosing to start the plan before the trial ends ("Start my plan now") ends the trial that day, charges the plan's full price, and starts its billing cycle from then. After the trial, an upgrade (a higher plan, or yearly instead of monthly billing) takes effect immediately: the price difference for the rest of the current billing period is charged right away and the additional AI Credits for the rest of that month are added. A downgrade (a lower plan, or monthly instead of yearly billing) takes effect at the end of the current billing period: nothing is charged or refunded for the rest of that period, and the current plan and its Credits continue until then. Each screen that changes a plan states what is charged that day and when the next charge is.

If a subscription payment fails, the Creator's storefront and checkout stay available for 5 days while the Creator retries the payment or updates the payment method in Pluff; AI features are paused during that time. If the payment has not succeeded after 5 days, the storefront is shown to visitors as unavailable until it does, and the Payment Processor may cancel the subscription at the end of its retry period. Buyers keep access to what they already bought.

You may cancel at any time in Settings → Billing (Cancel plan). Your plan stays active until the end of the period you already paid for — or, during a free trial, until the trial ends — and you are not charged again; nothing is charged for a trial cancelled before it ends. After that, your account is treated as having no active plan, as described in the section on the Free Trial. If a plan payment has failed when you cancel, the plan ends right away and the unpaid charge is not collected. You may resume a cancelled plan from the same place before it ends. You remain responsible for charges incurred before cancellation. Deleting an application, removing a link, disconnecting Stripe, or ceasing use does not by itself cancel a subscription.

Annual plans are billed in advance. Except where required by law or expressly stated in a written refund policy, subscription charges, annual charges, AI credit purchases, and Platform Fees are non-refundable. Pluff may offer a discretionary credit or refund without creating an obligation to do so in other cases.

8. Free Trial

Each Creator can start one 14-day free trial of a paid plan (Starter, Pro or Studio) and billing cycle (monthly or yearly), chosen when the trial starts. A valid payment method is required to start the trial. Nothing is charged during the trial. When the trial ends, the plan automatically converts to a paid subscription and the payment method is charged the plan's price for the chosen billing cycle, which then renews as described in the section on Creator Subscriptions and Automatic Renewal — unless the Creator cancels before the trial ends (in Settings → Billing), in which case nothing is charged. Pluff (through Stripe) emails the Creator about three days before the trial ends with the amount and date of the first charge. The trial includes a limited number of AI Credits and lets the Creator accept payments once their payout account is set up. A trial is available once per Creator.

Creators who started a trial without a payment method between October 2, 2026 and October 13, 2026 keep that trial: nothing is charged automatically when it ends, and Pluff emails them a few days before it ends, the day before, and when it ends. When such a trial ends without a paid plan — and at any time a Creator has no active paid plan (for example after cancelling) — the Creator keeps their account and everything they created and can keep editing it, but their storefront, product pages and checkout are shown to visitors as unavailable; no new orders, sign-ups, applications or bookings are accepted; the page cannot be published; and AI features are unavailable (purchased AI Credits stay on the account for use with a plan). Buyers keep access to what they already bought or joined. Choosing a plan restores all of this right away. A plan chosen during the trial is first charged on the trial's end date and then renews as described in the section on Creator Subscriptions and Automatic Renewal. Accounts that started a trial with a payment method between September 29, 2026 and October 1, 2026 keep that trial, which converts into the plan and billing cycle they selected unless they cancel before it ends.

Trial Credits are limited, non-transferable and non-refundable, and unused Trial Credits expire when the trial ends; purchased Credits are separate and do not expire, and can be used while the Creator has a plan. Pluff may restrict multiple trials, duplicate accounts, automated signups, or other conduct intended to obtain repeated free use.

9. Plan Features Platform Fees and Price Changes

Pluff's current standard monthly plans are summarized below. The pricing page and checkout display the controlling price, billing interval, included features, AI allowances, and Platform Fee before purchase.

PlanSubscriptionPlatform feeIncluded AI usage
Basic$5 monthly (monthly only)8 percentNone
Starter$19 monthly4 percentAs shown on pricing page
Pro$49 monthly2 percentAs shown on pricing page
Studio$99 monthlyNone (Stripe processing still applies)As shown on pricing page

Annual pricing, included credits, feature limits, promotional pricing, and any additional transaction-related charges are displayed at checkout or on the Pluff pricing page and may change as permitted by these Terms.

Basic. Basic is offered when a Creator cancels a paid plan, as a way to keep their page. It costs $5 a month, billed monthly, renews automatically until cancelled, and carries an 8 percent Platform Fee on each sale (Stripe processing still applies). Basic keeps the Creator's storefront online and lets them customize it, create guides, PDFs, products and links themselves, sell, and keep running what they already have — existing challenges, courses and communities, whose members keep their access. Basic does not include Pluff's AI features (AI chat, AI builds and edits, AI Credits and their purchase), connecting an AI app through Pluff's MCP connector, email marketing (campaigns and the Creator's automations; transactional emails such as receipts, booking emails and emails to existing members still go), or starting new challenges, courses or communities. On Basic, the PDFs Pluff makes from a Creator's guides carry a small “Made with Pluff” mark in their page footers and on the cover, and the guides' interactive player shows the same mark on its first and last screens; files the Creator uploaded themselves are not changed, and the mark goes away as soon as the Creator is on another plan. Like every plan, Basic lets the Creator export their account data, contacts, orders, uploaded files and guides' PDFs from Settings → Data controls. A Creator who chooses Basic stays on their current plan until the end of its paid period or trial and is then billed for Basic; they may keep their current plan instead before then, and may upgrade from Basic at any time. A membership subscription a Buyer already holds keeps the Platform Fee rate in effect when it started.

Stripe processing charges, currency-conversion charges, chargeback fees, payout fees, taxes, and other third-party costs are separate from Pluff's Platform Fee unless expressly stated otherwise. Stripe's fees for a dispute or chargeback on a Creator's sale (for example, a fee when a dispute is opened and another when it is challenged, which Stripe returns if the Creator wins) are the Creator's and may be collected from the Creator's Stripe balance at cost. A Creator must not represent that Pluff or Stripe processing is free when fees apply.

Pluff may change prices, included usage, or Platform Fees prospectively. For an existing paid subscription, material subscription-price changes ordinarily take effect at the next renewal after reasonable advance notice. Changes required by law, payment networks, fraud conditions, or third-party costs may take effect sooner where permitted. Continuing to use paid features after a change takes effect constitutes acceptance.

10. AI Credits and Usage

AI Credits are usage units for eligible AI-assisted actions. Different actions may consume different amounts based on length, model, media type, complexity, or processing cost. Current credit costs are listed on the Pluff pricing and billing pages. Because the cost of a generation depends on the size of what is actually built, Pluff may hold the largest applicable amount when a generation starts and returns any unused Credits when it finishes. Manual editing, rearranging content, uploading Creator Content, viewing analytics, ordinary storefront visits, and Buyer access do not consume AI Credits unless clearly disclosed.

Monthly subscription Credits reset at the end of the applicable billing cycle and do not roll over unless the plan expressly says otherwise. Purchased top-up Credits do not expire while the account remains open; they can be bought and used while the Creator has a paid plan or free trial, and wait on the account while it has neither. When a Creator buys Credits, the payment method is saved to their account. If the Creator turns on auto top-up, they authorize Pluff to charge that saved payment method for the selected Credit pack each time their Credit balance falls below the threshold they chose, no more than once per hour, until they turn auto top-up off in Billing; a declined charge turns auto top-up off. Credits have no cash value, are not legal tender, and cannot be transferred. Permanently closing the account forfeits unused Credits except where the purchase terms or applicable law require otherwise.

Credits held for a generation that fails are returned automatically, and Pluff may restore Credits consumed by another verified technical failure. Dissatisfaction with a completed generation does not automatically entitle a user to a Credit refund, although Pluff may provide regeneration tools or discretionary restoration. Pluff may impose usage limits, concurrency limits, abuse controls, or temporary rate limits to protect availability and cost integrity. AI chat (asking Pluff's AI questions and to make changes, which uses no Credits) is included with each plan up to a monthly allowance that is larger on higher plans and smaller during a free trial; when it runs out, chat resumes at the start of the next month (UTC), while builds and edits paid with Credits keep working.

11. Creator Storefronts Products and Delivery

Creators may create and publish link-in-bio storefronts and Creator Products using Pluff's editors, templates, hosting, media, AI features, and delivery tools. Creators must review all product content before publication, accurately describe what Buyers will receive, disclose material limitations, and keep links and delivery materials functional.

Pluff may host interactive browser experiences and generate or deliver optional PDF companions. A PDF, preview, template, or AI-generated draft may not perfectly reproduce every interactive effect. Creators must test the public experience and mobile presentation before marketing it.

Creators must honor advertised access periods, start dates, capacity limits, live-session commitments, bonuses, and support promises. A Creator may not materially reduce a paid Buyer's access after purchase without the Buyer's consent or a lawful refund. Pluff may preserve Buyer access to previously purchased hosted content following Creator cancellation or suspension when technically and legally feasible.

A Creator may place a product in waitlist mode, optionally with an opening time. While a product is on a waitlist, Pluff does not accept orders for it and visitors may only leave an email address; the product opens automatically when the opening time passes or when the Creator turns the waitlist off. A countdown shown on a storefront is informational and set by the Creator. Pluff sends email to waitlist and subscriber lists only when the Creator uses Pluff's email tools (see Email marketing below).

Applications. A Creator may add an application, sign-up or waitlist form to their link in bio. A visitor who applies gives that Creator their name, email address and answers. The Creator decides who is approved — or sets the form to approve everyone — and Pluff emails the applicant the Creator's messages: that the application arrived, and the Creator's decision. When approved, the applicant receives what the Creator set approval to give: an invite link to a community hosted on another service, access to the Creator's Pluff community, a free product, or a private link to buy or book a product. Applying is free and does not guarantee approval. The Creator is responsible for their questions, decisions and emails, and a community or service hosted elsewhere is run by the Creator and that service, not Pluff.

Testimonials. A Creator may ask the people who got a product how it was. Only people who got the product can answer, and a Creator may show on their page only the answers whose authors allowed it, with the author's first name. Creators may not write, change, buy or reward reviews (including with discounts, free products or entries into anything), ask only people likely to be happy, or pick and present reviews in a way that misleads about what most people thought. Pluff shows no star ratings or review counts on Creator pages and may remove reviews or this feature where it is misused.

Challenges and courses. A challenge is a program the Creator runs on Pluff: days that open on a schedule (or at each member's own pace), live calls the Creator hosts on their own video service (such as Zoom, Google Meet, YouTube Live or Instagram Live), replays the Creator posts, check-ins, and a private group for each round. Live calls take place on that service under its own terms; Pluff shows the link and the replay but does not host or record calls. A course is the modules and lessons the Creator publishes, opening all at once or over time. The Creator is responsible for running what they advertise — the start date, the days, the calls, the replays and their content — and members who fall behind keep access to the days that have opened.

Paid rounds and waitlists. A Creator may let people pay to join a round before it starts, or collect a free waitlist and open the doors later — sometimes at a lower waitlist price for a limited time, set by the Creator. Anyone who pays for a round that hasn't started (including from a waitlist when doors open) is charged at that moment, and the round's days open when it starts. If a Creator cancels a round, moves its start materially, or doesn't run it as described, the Creator must offer each paid member a full refund — or, if the member agrees, a place in another round. Refunds are issued by the Creator from their own Stripe account as described under Refunds, Disputes and Chargebacks.

Challenge emails. When someone joins a challenge, Pluff emails them in the Creator's name that they're in, with their access link. Pluff also sends, counted against the Creator's monthly email allowance: when doors open (to the waitlist), the day before a round starts, at most one email a day with that day's action, a reminder shortly before each live call, a note when a round ends, and a congratulations when they finish. Every daily email has a link to stop daily emails for that challenge. Courses that open one lesson a day or a module a week also email each member, counted the same way, when their next lesson or module opens, with a link to stop those emails. The Creator is responsible for what these emails say on their behalf (the day's action, call titles and links, replays). When the allowance runs out, routine emails stop and the challenge keeps working in the app.

Communities. A Creator may run a community on Pluff as a product: a members-only space at the product's link with posts, topics, polls, search, events, messages, a members directory, a Classroom, and points, levels and a leaderboard. A community may be free, a one-time purchase or a membership that renews until cancelled; checkout, trials, refunds and platform fees work as for any other product. Points are counted only from reactions other members give a member's posts; they have no cash value, can't be bought, sold or exchanged, and the Creator may turn them off. Events are live calls on the Creator's own video service (such as Zoom, Google Meet or YouTube Live) under that service's terms; Pluff shows the link and each event's time in the viewer's time zone but does not host or record calls. The Classroom lists challenges and courses the Creator includes with the community: members may start them without paying for them separately while their community access lasts, subject to each challenge's own rounds, spots and doors and to any level or time in the community the Creator requires first. When a member's community access ends — they cancel, a payment fails, they're refunded or they're removed — what the Classroom gave them ends too, unless they bought it separately. Members can leave the group, or cancel a renewing community, from inside the community; cancelling stops future charges and access lasts to the end of the period already paid for.

Community emails. Pluff emails a community's members in the Creator's name: the receipt when they join (for a membership, also the price, the date of the first charge and how to cancel), a reminder shortly before each event (at most one a day), at most one email a day when someone replies to them or the host answers their question, a weekly summary when there's something new, and the host's updates when the Creator chooses to email everyone. Apart from the receipt, these count against the Creator's monthly email allowance, and each member can switch them off for that community in one place; their access still works. The Creator is responsible for what these emails say on their behalf.

Moving a community to Pluff. A Creator may bring members over from another platform by uploading that platform's member export or a list of emails, or by sharing a claim link people can use to ask to be let in. By importing a list, the Creator confirms that they run that community and have the right and a lawful basis to move its members to Pluff (for a Patreon list, also the confirmation Pluff asks for); that the list is their own members, not bought, rented, scraped or taken from a service that doesn't allow it; and that before inviting anyone who will keep paying on Pluff they have stopped those members' renewals on the old platform, so no one is charged twice. Pluff reads the file in the Creator's browser, keeps only what the move needs, emails each person an invite and at most three reminders on the Creator's behalf in waves within Pluff's sending limits, and may pause a move whose invites bounce or draw complaints. For members who were paying, the Creator chooses for each move: free access until the date they've already paid through, then the lower of their old price and the community's current price at the same billing interval (or their old price at their old interval); free access until that date, then the community's current price; or everyone joins again at today's price. People can choose "Don't move me" in any invite, and people who never arrive are removed as described in the Privacy Policy. The Creator is responsible for the names, dates and prices in their export and for everything that happens on the old platform.

Email marketing. Creators on an active plan that includes it (every plan except Basic) can email their own contacts through Pluff: one-off emails, scheduled emails, and automations they turn on (such as a welcome email, waitlist and launch emails, post-purchase check-ins, reminders to finish a self-paced challenge or a course, a congratulations when someone finishes, feedback requests, a follow-up to subscribers who haven't bought, a next-product offer, a reminder to someone who left checkout after agreeing to receive emails, call reminders and follow-ups, and a note when a membership ends). Contacts come from people who subscribed, joined a waitlist, bought, or joined a challenge on the Creator's page, and from lists the Creator imports. The Creator is the sender and is responsible for the content and for complying with anti-spam and privacy laws (including CAN-SPAM, CASL and GDPR where they apply): the Creator may email only people who agreed to hear from them, may not import purchased, rented or scraped lists, and must provide a valid postal address, which Pluff adds to every marketing email. Pluff adds an unsubscribe link and one-click unsubscribe to every marketing email and stops sending to anyone who unsubscribes. Each plan includes a monthly number of marketing emails shown in the app. Pluff may limit, pause or end a Creator's sending for high bounce or complaint rates, misleading content, or other abuse that harms deliverability for others.

Storefronts may include music players (audio snippets the Creator uploads, or official embeds from services such as Spotify, Apple Music and SoundCloud) and stock photos from Pexels. Creators may upload only audio they own or are licensed to share. Embedded players are provided by those services under their own terms, and stock photos remain subject to the Pexels license.

Affiliate links and discount codes. Creators may add affiliate product picks (for example from Amazon or a brand's store) and brand discount codes to their storefront. The Creator is responsible for their relationship with each brand or affiliate program, for following its rules (including the Amazon Associates Program Operating Agreement), for the accuracy of product names, prices, codes and end dates they enter, and for disclosing their material connection to brands as the FTC's Endorsement Guides and similar laws require. Whenever affiliate picks, codes or Amazon links are shown, Pluff displays a commission disclosure (and Amazon's required statement for Amazon links) on the storefront; this helps but does not replace the Creator's own disclosures in their posts and videos. Creators may also share their own videos from TikTok, Instagram or YouTube and tag what's in them; those videos play in the platform's official player under that platform's terms, and the Creator must have the right to share them. Pluff automatically gives each brand on a storefront its own page listing that brand's picks and codes. Creators on the Studio plan may also sell or give away a full video that plays on their storefront (“full video in my bio”); if the plan ends, people who already unlocked a video keep access, but new visitors can’t unlock it until the Creator is on Studio again: either a file they upload, streamed only to people who unlocked it, or a video on YouTube, Vimeo, Loom, Wistia or Google Drive that plays in that provider's player; it can be open to everyone, shown after a visitor enters their name and email (which adds them to the Creator's list), or sold. The Creator must own or have the right to share every video, and a provider-hosted video stays subject to that provider's terms and privacy settings — Pluff never shows its link on the page, but can't stop the provider from making it reachable elsewhere. Affiliate links open the brand's own website, whose terms, prices and privacy practices apply; Pluff is not a party to purchases made there, does not receive or pay affiliate commissions, and does not guarantee that any code works. Pluff may read a product page's public title, photo and price when a Creator asks it to fill in a pick (never for Amazon, whose rules don't allow it; Pluff also never shows a price on an Amazon pick), and counts taps on links, picks and codes anonymously so the Creator can see what works.

Substack. A Creator may connect their Substack publication. Pluff then reads the publication's public feed (about every 15 minutes) to show its newest posts on the Creator's storefront with a Subscribe button, and — while that shelf is switched on — may put it at the top of the page for two days and give the newest post a keyword link when a new post comes out. Pluff never emails anyone because of a new post. The Subscribe form is Substack's own, shown from Substack only when a visitor taps Subscribe, and subscribing happens under Substack's terms. A Creator may also upload the subscriber list they export from Substack so their paid subscribers get a community, course or challenge free. By uploading it, the Creator confirms the list is their own, that the people on it subscribed to the Creator's publication, and that the Creator may use those email addresses to give them this access and to send them the invite; Pluff keeps only the paid subscribers, uses the list only for that access and the invites the Creator chooses to send, and no one on it gets the Creator's marketing emails before they come in. Someone on the list can also claim their free spot from the product's page with the same email. People who come in keep their spot if the list is later replaced or removed; Pluff does not check whether they still pay on Substack.

12. Buyer Transactions

A Buyer's purchase is a transaction with the applicable Creator. Before purchasing, Buyers should review the Creator's identity, description, price, delivery method, recurring-payment terms, refund policy, and any age, geographic, or professional limitations. Pluff may display checkout information and facilitate delivery, but does not independently verify every claim made by a Creator.

Buyers must provide accurate contact and payment information and may not use stolen payment credentials, initiate abusive disputes, obtain content through deception, share access credentials, circumvent access controls, or reproduce or redistribute Creator Products beyond the license provided.

Creators may offer sale prices, pay-what-you-want pricing (never below the Creator's minimum), discount codes, an optional add-on before payment (an "order bump"), bundles that unlock several products, and a one-time offer right after a purchase. When a Creator offers an after-purchase offer, Stripe keeps the Buyer's payment method on the Creator's connected account so the Buyer can accept that offer with one tap; it is charged only if the Buyer taps to accept, within two hours of the original payment, for the price shown. Otherwise the Buyer can pay through a separate checkout or decline. Each accepted add-on or offer is a separate order under these Terms and the Creator's refund policy.

Tip jars. A Creator may add a tip jar so visitors can send them a voluntary payment of an amount the visitor chooses (at least $1). A tip is a gift to the Creator, not a purchase: it unlocks nothing unless the Creator chooses to send a thank-you link, and the Creator's goal, if shown, is their own. Tips are processed like other sales — on the Creator's connected Stripe account, with the same platform fee — and refunds are at the Creator's discretion. A visitor may add a name and a note and choose whether they appear on the Creator's page; the Creator may hide any of them.

Some Creator Products are memberships that renew automatically every week, month, or year at the price shown at checkout, until cancelled, and may begin with a free trial after which the first payment is charged unless cancelled first. A Buyer can cancel a membership at any time from the product's purchase page on Pluff (or by contacting the Creator); cancellation takes effect at the end of the period already paid for, and access ends then. A Creator may also offer a payment plan, in which the price is split into a set number of monthly payments charged automatically to the same payment method; access begins at purchase and continues after the final payment, and may end if a payment fails and is not recovered. Creators must describe what members receive and must not change a membership's price for existing members without notice required by law.

Keeping your spot in a moved community. If a Creator moved you from another platform, your invite and the Keep my spot screen show the exact price, how often it renews and the date of the first charge. By tapping Keep my spot and saving a card, you authorize the Creator, through Stripe, to charge that price on that date and again every period after until you cancel. Pluff emails you about 7 days before the first charge, and you can cancel at no charge before that date from the community or the link in your email; after it, cancelling stops future charges. If you don't keep your spot, your access ends when your free period does. Stopping billing on the old platform is the Creator's responsibility; if you're charged twice for the same period, contact the Creator, who must refund the duplicate.

Digital access may begin immediately after successful payment. By requesting or receiving immediate delivery, a Buyer acknowledges that the product may be consumed before any statutory cancellation period expires, to the extent such acknowledgment is permitted by applicable law.

13. Refunds Disputes and Chargebacks

Each Creator must maintain a clear and lawful refund policy. Unless a separate Creator policy provides more favorable terms, Buyers should first contact the Creator through the contact method shown on the receipt or product page. Pluff may provide communication tools or help route a request but does not guarantee a particular outcome.

Because payments are direct charges on the Creator's connected account, Stripe debits refunds, disputes, chargebacks, and related amounts from the Creator's Stripe balance. The Creator is responsible for refunds, reversals, disputes, chargebacks, penalties, and delivery failures attributable to the Creator's transactions, subject to the Stripe arrangement and applicable law. Pluff may deduct amounts owed to Pluff from amounts payable to the Creator, suspend sales or payouts, require reimbursement, or take other lawful collection action.

Creators must respond promptly to information requests and preserve evidence of product descriptions, Buyer consent, delivery, access, communications, and refund decisions. Excessive disputes, misleading products, non-delivery, or failure to respond may result in restrictions or termination. Payment-processing fees from an original transaction may not be returned when a refund is issued.

Creators can issue a full refund of a Buyer's order from the Payments page in Pluff. The refund is created on the Creator's connected Stripe account and paid from the Creator's Stripe balance; the Platform Fee and Stripe's processing fee for the original payment are not returned. A fully refunded order no longer grants access to the product, including refunds a Creator issues directly in Stripe. Pluff emails the Buyer a refund confirmation on the Creator's behalf.

14. Payouts Holds and Reserves

Payout timing, availability, and method depend on the Creator's connected account, available balance, country, bank, card eligibility, transaction history, risk level, weekends, holidays, and Stripe rules. Standard payouts carry no Pluff payout fee, although Stripe, a bank, or another provider may impose a separately disclosed charge. New connected accounts are set to standard payouts once a week (currently every Friday); the Creator can change the schedule in Payments. Any reference to a standard or estimated payout time is not a guarantee.

If Pluff offers Instant Payouts, only eligible Creators and eligible available balances may use them. Pluff's current Instant Payout fee is 2.5 percent of the payout amount on every plan, with a minimum fee of $0.50 per Instant Payout. The confirmation screen displays the controlling fee before submission. An Instant Payout does not eliminate the possibility of later refunds, disputes, reversals, negative balances, reserves, or collection obligations.

Pluff or Stripe may delay, hold, reserve, offset, or restrict amounts when reasonably necessary for legal compliance, suspected fraud, anticipated refunds or disputes, negative balances, processor requirements, sanctions screening, or protection of users and the Service. Pluff does not provide credit, lending, escrow, deposit accounts, or guaranteed liquidity through these features.

15. Taxes and Reporting

Creators are responsible for determining and satisfying all income, sales, use, gross-receipts, value-added, digital-goods, and other tax obligations arising from their business and Creator Products. Pluff does not provide tax, accounting, or legal advice.

Pluff or Stripe may collect tax information, issue tax forms, withhold amounts, calculate taxes, or provide tax-related tools where legally required or enabled. These services do not relieve a Creator of responsibility for classifying products, identifying nexus, registering, filing returns, remitting tax, and maintaining records. Buyers are responsible for taxes imposed directly on them unless collected at checkout.

16. AI Assisted Features

Pluff uses artificial intelligence to help structure, draft, transform, summarize, style, and refine content. AI Output is probabilistic and may be incomplete, inaccurate, repetitive, biased, inappropriate, non-unique, or similar to output provided to others. Pluff does not guarantee factual accuracy, originality, copyrightability, legal compliance, commercial performance, or fitness for a particular purpose.

Creators must review, edit, fact-check, test, and approve every AI Output before publishing or selling it. A Creator may not describe AI Output as professional medical, legal, financial, mental-health, safety, or other regulated advice unless the Creator is properly qualified and the content complies with applicable law and professional standards.

Voice matching: to make AI Output sound like the Creator, Pluff's AI uses excerpts of the Creator's own writing and examples of how the Creator edited earlier AI Output (see the Privacy Policy). A Creator should add only writing they wrote or have the right to use; Pluff uses it only for that Creator's account. A light check after a build may rewrite individual lines of that build's AI Output that don't match the Creator's voice; it never changes text the Creator wrote or edited.

Products built or changed with AI-assisted features are saved as unpublished drafts, each with its own version. Nothing an AI feature produces is shown to Buyers until the Creator publishes it, and a Creator can restore an earlier published version at any time.

Creators must have rights to all material supplied to an AI feature and must not submit confidential third-party information, protected health information, payment-card data, government identifiers, trade secrets, or content they are not authorized to process. Inputs — including any files a Creator attaches to an AI request or their connected AI app hands Pluff for a build, and any pages or documents a Creator asks the AI to import from a link — and related context may be transmitted to Pluff's infrastructure and to Pluff's AI providers — Anthropic (Claude), and Lovable's AI Gateway and its underlying AI service providers as a backup — to generate output and secure the Service.

As between Pluff and the Creator, the Creator retains rights in Creator-provided inputs and, to the extent permitted by law, owns the AI Output generated specifically for that Creator, subject to Pluff's rights in its platform, templates, components, prompts, styles, and preexisting materials. Pluff does not promise that AI Output is exclusive or protectable.

17. Creator Content and Licenses

Creators retain ownership of Creator Content. By submitting Creator Content, a Creator grants Pluff a worldwide, non-exclusive, royalty-free license to host, copy, process, reproduce, format, modify for technical compatibility, display, distribute, transmit, create delivery formats from, and otherwise use that content as reasonably necessary to operate, secure, support, improve, and provide the Service.

For public storefronts and public Creator Products, the license includes using names, handles, logos, product titles, thumbnails, previews, screenshots, and short excerpts to display the storefront, generate link previews, identify the Creator, provide search or recommendations, and market or demonstrate Pluff. Pluff will not use private unpublished Creator Content in public marketing without permission.

The Creator represents that the Creator Content and Pluff's authorized use of it do not infringe intellectual-property, privacy, publicity, confidentiality, contractual, or other rights. The Creator must obtain releases and permissions for people, brands, music, footage, testimonials, photographs, and other protected material included in a Creator Product.

18. Buyer Access and Product Licenses

Unless a Creator clearly states different lawful license terms, a completed purchase grants the Buyer a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Creator Product for the Buyer's own non-commercial purposes. The Buyer does not acquire ownership of the Creator's intellectual property.

A Buyer may not resell, sublicense, publicly display, publish, distribute, scrape, reproduce, share login access to, remove ownership notices from, train a competing system on, or create a substantially similar commercial product from a Creator Product except with the Creator's written permission or as permitted by law. Access may be restricted for infringement, fraud, chargebacks, credential sharing, or material breach.

19. Pluff Intellectual Property

Pluff and its licensors own the Service, software, source and object code, workflows, product-generation systems, templates, components, interfaces, designs, animations, branding, documentation, databases, compilations, and all related intellectual-property rights, excluding Creator Content.

Subject to these Terms, Pluff grants each user a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No right is granted to copy, reverse engineer, decompile, scrape, benchmark for publication, extract models or prompts, circumvent technical protections, create a competing service from Pluff's confidential elements, or use Pluff marks without permission.

The workspace, its interfaces, flows, walkthroughs, templates, slideshow designs, AI behavior and overall look and feel are Pluff's confidential and proprietary trade dress. You may not copy, imitate or recreate them; record or publish the workspace to help anyone do so (sharing your own results and page is fine); or use an account to research, design, build or train a competing product. Pluff may suspend or close accounts that do this and pursue every remedy the law allows.

"Pluff," its logo, and related names and designs are Pluff marks. Creator use of approved badge, embed, or referral materials must follow Pluff's brand guidelines and ends when authorization or the account ends.

20. Acceptable Use

You may use the Service only lawfully and in accordance with these Terms. You may not interfere with the Service; probe or defeat security; introduce malware; overload infrastructure; automate access beyond documented interfaces; scrape personal data; falsify engagement, sales, proof, reviews, testimonials, or analytics; evade usage or fee limits; or assist another person in doing so.

You may not harass, threaten, exploit, discriminate against, defame, stalk, dox, impersonate, or invade the privacy of another person. You may not use Pluff to coordinate illegal activity, manipulate Buyers, conceal material terms, make false scarcity claims, use fabricated credentials, or promise guaranteed health, income, investment, legal, or personal outcomes.

Pluff's checks are a courtesy, not a review. Pluff may point out lines that look like a promise of results, a missing disclaimer, a placeholder or a risky link. These notes are automated suggestions: they can miss problems and can flag content that is fine, and you may keep anything they flag. Whether or not Pluff flags something, you decide what you publish and you remain solely responsible for it — including any income, health or results claims, the disclosures and disclaimers they need, and compliance with the rules of the platforms where you share your link.

Creators must maintain reasonable customer support and must not use purchased customer information for unrelated marketing without lawful notice and consent.

Communities. Everything posted in a Creator's groups and community — posts, comments, photos, profiles and messages — must follow these Terms and the group's ground rules (the Creator's rules shown when a member joins). Be kind and constructive, don't spam or promote unrelated offers, and don't post other people's personal information, private messages, or content you don't have the right to share. The Creator hosts their groups and is responsible for moderating them: the Creator, and the moderators they choose, may remove posts and comments, pin an announcement, mute a member for 24 hours, and remove a member from a group (a removed member keeps access to the days they paid for, but not to the group). Any member can leave a challenge or course group, keeping access to the days they paid for, and take down their posts and comments there. Any member can report a post, comment, profile or message, and can block another member. Reports go to the Creator; reports of scams, self-harm or illegal content also go to Pluff, which may remove content or restrict accounts where it breaks these Terms or the law. If you think your content or your place in a group was removed by mistake, ask the Creator, or contact Pluff at support@pluff.social and we'll review it.

Messages. Members can message the Creator and — when the Creator allows it — each other; the Creator may limit messages to questions for them, or to announcements only. Nobody may ask a member to pay, or to move to another app or payment method, in messages: payment for a Creator's products happens only through Pluff checkout. Report any message that does; Creators who do it may lose access to messages or to Pluff.

21. Prohibited Products and Conduct

The following are prohibited unless Pluff gives written approval and all legal and processor requirements are satisfied: illegal goods or services; fraud or deceptive business opportunities; pyramid or Ponzi schemes; counterfeit or infringing products; stolen data; malware; weapons; controlled substances; unlicensed gambling; explicit sexual services; hate or violent-extremist content; harassment services; fake documents; evasion tools; unauthorized financial services; unlicensed medical treatment; and products prohibited by Stripe or applicable card-network rules.

Pluff may prohibit additional categories based on safety, fraud, reputation, processor requirements, or legal risk. A product's omission from this list does not mean it is allowed. Creators must review then-current acceptable-use and payment-processor restrictions before selling.

22. Regulated and High Risk Content

Content concerning health, nutrition, fitness, mental health, finance, credit, investing, taxes, law, employment, housing, education, children, or other sensitive matters must be framed as general educational information unless provided by a properly licensed professional acting within scope. Appropriate qualifications, limitations, risks, and emergency guidance must be disclosed.

Pluff is not designed to store protected health information on behalf of covered entities and does not enter into a HIPAA business associate relationship unless expressly agreed in writing. Creators may not use Pluff for diagnosis, emergency services, prescriptions, individualized treatment, custody decisions, credit decisions, employment screening, or other high-impact decisions without prior written approval and all legally required safeguards.

No Creator may guarantee earnings, cures, weight loss, investment returns, legal outcomes, or other results. Testimonials must be genuine, authorized, and accompanied by disclosures required by law.

23. Moderation Verification and Enforcement

Pluff may use automated and manual systems to review account, content, transaction, device, and usage signals for security, fraud, abuse, legal compliance, and policy enforcement. Pluff may request records, credentials, licenses, identity information, source materials, or customer-support evidence.

Pluff may remove or restrict content, place a product in review, delay publication, suspend checkout, limit AI use, preserve evidence, contact affected users, or terminate accounts when Pluff reasonably believes action is needed. Pluff is not obligated to monitor every product and does not endorse content merely because it remains available.

Where appropriate, a user may appeal a moderation decision by contacting legal@pluff.social with the account email, affected content, and supporting information. Pluff may decline repetitive, abusive, fraudulent, or legally prohibited appeals.

24. Copyright Complaints

Pluff respects intellectual-property rights. A copyright owner or authorized agent may send a notice to legal@pluff.social identifying the copyrighted work, the allegedly infringing material and its location, contact information, a good-faith statement, an accuracy and authority statement under penalty of perjury, and a physical or electronic signature.

A user whose material is removed may submit a legally sufficient counter-notice. Pluff may forward notices and counter-notices to the affected parties and restore content as permitted by law.

Repeat infringers. Pluff terminates, in appropriate circumstances, the accounts of users who repeatedly infringe copyright — including any account that receives three valid notices within twelve months that are not resolved by a successful counter-notice. The full notice, counter-notice and repeat-infringer process is at pluff.social/dmca.

25. Feedback Aggregated Data and Service Improvement

If you provide suggestions, ideas, requests, or feedback, you grant Pluff a perpetual, worldwide, royalty-free right to use them without restriction or compensation, provided Pluff does not publicly identify you as the source without permission.

Pluff may create aggregated or de-identified statistics from use of the Service, such as generation patterns, product structures, feature adoption, conversion ranges, performance benchmarks, error rates, and fraud signals. Pluff may use and disclose that information to operate, analyze, secure, improve, and develop the Service, provided it is not used to identify an individual and Pluff does not attempt to re-identify it.

Private unpublished Creator Content will not be used in public marketing without consent. Pluff will not intentionally authorize third-party providers to train public general-purpose models on private Creator Content when contractual or technical controls are available to prevent that use.

26. Privacy

The Pluff Privacy Policy explains how Pluff collects, uses, shares, retains, and protects personal information. By using the Service, you acknowledge those practices. Creators who collect Buyer information through their storefronts are independently responsible for providing legally required privacy notices and honoring applicable privacy rights.

A Creator may use Buyer data only to deliver and support the purchased product, administer the customer relationship, comply with law, and conduct marketing for which the Creator has a lawful basis and any required consent. Creators may not sell Buyer data, scrape it, enrich it with unlawfully obtained information, or use it for discriminatory or unrelated purposes.

27. Third Party Services

The Service relies on third parties, including Stripe for payments and connected accounts, Lovable and related infrastructure for the application, Anthropic and Lovable's AI Gateway for AI functionality, Cloudflare for network services and video storage, Resend and Amazon Web Services for email delivery, cloud and database providers, underlying AI-model providers, email and communications vendors, analytics, fraud prevention, and support tools. Third-party terms and privacy practices may apply.

Pluff is not responsible for third-party services, websites, integrations, outages, security failures, policy changes, or content outside Pluff's reasonable control. Links do not imply endorsement. You authorize Pluff to exchange information with a connected service as necessary to enable the integration you request.

28. Service Availability and Changes

Pluff may add, remove, redesign, limit, or discontinue features and may perform maintenance without liability. We aim to provide a reliable Service but do not guarantee uninterrupted availability, error-free operation, permanent storage, a particular AI model, a particular layout, or continued compatibility with every browser, in-app browser, device, integration, or payment method.

Beta, preview, experimental, and early-access features may be incomplete, changed without notice, subject to lower limits, or discontinued. Unless expressly stated otherwise, they are provided without service-level commitments.

29. Suspension Cancellation and Termination

You may cancel a subscription through account settings. Pluff may suspend or terminate access immediately for fraud, illegal conduct, safety risk, processor restriction, nonpayment, infringement, repeated disputes, serious breach, or conduct that threatens users or the Service. For other material breaches, Pluff may provide notice and a reasonable opportunity to cure when appropriate.

When a subscription ends, new orders and AI generation pause, and custom publishing or other paid functionality may be disabled. Existing Buyers retain access to previously purchased content to the extent technically and legally feasible. Creators remain responsible for unresolved transactions, refunds, disputes, taxes, and amounts owed.

Sections that by their nature should survive termination survive, including payment obligations, intellectual-property provisions, licenses needed to preserve Buyer access, disclaimers, liability limits, indemnification, dispute resolution, and general provisions.

30. Data Access After Termination

Before cancellation, Creators should export available customer and product records. On every plan, Settings → Data controls lets a Creator download their account data (as a file), their contacts and orders (as spreadsheets), every file they uploaded and their guides' PDFs. Pluff may provide a limited period to retrieve account information after termination, but does not guarantee indefinite storage. Pluff may retain records as required for transactions, Buyer access, fraud prevention, dispute handling, backups, legal compliance, and legitimate business purposes.

Account deletion does not require Pluff to delete information that must be retained by law, is needed to complete a transaction, protects legal rights, exists in secure backups pending ordinary deletion, or has been lawfully de-identified. Buyer licenses and delivery records may remain available after a Creator account ends.

31. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, AI FEATURES, TEMPLATES, HOSTING, PAYMENT-RELATED TOOLS, CREATOR PRODUCTS, AND ALL RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." PLUFF DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, SECURITY, AVAILABILITY, AND RESULTS.

PLUFF DOES NOT WARRANT THAT A CREATOR WILL EARN MONEY, ATTRACT CUSTOMERS, ACHIEVE A PARTICULAR CONVERSION RATE, RETAIN BUYERS, OR OBTAIN ANY BUSINESS RESULT. PLUFF DOES NOT WARRANT THE ACCURACY, ORIGINALITY, SAFETY, LEGALITY, OR QUALITY OF AI OUTPUT OR CREATOR PRODUCTS. YOU USE AND RELY ON THEM AT YOUR OWN RISK.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS. IN THAT EVENT, THE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED.

32. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUFF AND ITS OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; COST OF SUBSTITUTE SERVICES; OR LOSSES ARISING FROM CREATOR PRODUCTS, AI OUTPUT, PAYMENT-PROCESSOR ACTIONS, ACCOUNT SUSPENSION, UNAUTHORIZED ACCESS, OR SERVICE INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUFF'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS OR THE AMOUNT THE CLAIMANT PAID DIRECTLY TO PLUFF DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. AMOUNTS PAID TO A CREATOR FOR A CREATOR PRODUCT ARE NOT AMOUNTS PAID TO PLUFF FOR PURPOSES OF THIS LIMIT.

These limitations do not exclude liability that cannot lawfully be excluded, including liability for intentional misconduct where applicable. The allocation of risk in this section is an essential basis of the agreement.

33. Indemnification

You will defend, indemnify, and hold harmless Pluff and its operators, affiliates, service providers, licensors, and representatives from claims, proceedings, losses, liabilities, penalties, damages, judgments, and reasonable legal fees arising from your Creator Products, Creator Content, business, customer relationships, taxes, refunds, disputes, violation of law, violation of third-party rights, misuse of the Service, or breach of these Terms.

Pluff may control the defense of an indemnified matter with counsel of its choice. You may not settle a matter in a way that admits fault by or imposes obligations on Pluff without written consent. This section does not require a consumer to indemnify Pluff to the extent prohibited by applicable law.

34. Dispute Resolution and Arbitration

Please contact legal@pluff.social before filing a formal claim. The notice must describe the issue, relevant account and transaction information, requested relief, and supporting documents. The parties will attempt in good faith to resolve the dispute for 30 days after receipt.

Except for eligible small-claims matters and requests for temporary or injunctive relief involving intellectual property, security, fraud, or unauthorized access, any dispute arising from these Terms or the Service will be resolved by binding individual arbitration under the Federal Arbitration Act. Consumer disputes will be administered under the American Arbitration Association Consumer Arbitration Rules; other disputes will be administered under the applicable AAA Commercial Arbitration Rules. Arbitration may occur by video, telephone, documents, or at a reasonably convenient location as determined under the applicable rules.

YOU AND PLUFF WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY'S CLAIM.

You may opt out of this arbitration agreement by emailing legal@pluff.social within 30 days after first accepting these Terms. The message must include your full name, account email, mailing address, and an unambiguous statement that you opt out of arbitration. Opting out does not affect any other provision.

If the class-action waiver or a material portion of this arbitration section is found unenforceable for a particular claim, that claim will proceed in a court of competent jurisdiction and the remaining claims will be arbitrated. Nothing prevents either party from reporting conduct to a government agency.

35. Governing Law

These Terms and any non-arbitrable dispute are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration provisions. Subject to the arbitration section, the parties consent to exclusive jurisdiction in the state and federal courts located in Florida, unless consumer law requires another forum.

36. Electronic Communications

You consent to receive agreements, disclosures, receipts, trial and renewal notices, policy updates, security alerts, and other communications electronically. Pluff may deliver them through email, account notifications, the Service, or the contact information associated with your account. You are responsible for maintaining a valid email address and reviewing notices.

Marketing communications are optional where required by law. Transactional, security, legal, billing, and service messages are necessary to operate an account and may continue even if you unsubscribe from marketing.

37. Export Sanctions and Compliance

You may not use the Service in violation of United States export-control, sanctions, anti-boycott, anti-money-laundering, or anti-bribery laws. You represent that you are not located in, ordinarily resident in, organized under the laws of, or acting for a prohibited jurisdiction or sanctioned party, and are not using Pluff for prohibited transactions.

38. Changes to These Terms

Pluff may update these Terms to reflect new features, pricing, legal requirements, risk controls, or business practices. The "Effective date" will be updated. When a change materially affects existing users, Pluff will provide reasonable notice through email or the Service before it takes effect, unless immediate change is required for legal, security, or fraud reasons.

Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the affected Service and cancel before the change takes effect. Changes do not retroactively alter completed Buyer transactions unless required by law or agreed by the affected parties.

39. General Provisions

These Terms, the Privacy Policy, applicable checkout terms, and referenced policies are the entire agreement concerning the Service. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder remains effective.

You may not assign these Terms without Pluff's written consent. Pluff may assign them in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service. Headings are for convenience. "Including" means "including without limitation." Electronic copies and acceptances have the same effect as originals.

No person other than the parties has a right to enforce these Terms, except Pluff's operators, affiliates, licensors, service providers, and representatives may rely on provisions expressly benefiting them.

40. Partner Program

Joining. Creators with more than 10,000 active followers on at least one social platform and a personal brand may apply to the Pluff Partner Program from their Pluff account (details at https://pluff.social/affiliates). Applicants share the profile links where they have that audience and upload a screenshot showing the follower count. A real person at Pluff reviews every application and may accept or decline any application at Pluff's discretion. Once approved, you are a "Partner" and receive a personal referral link and a dashboard. Partners are independent contractors, not employees, agents or representatives of Pluff, and may not make commitments on Pluff's behalf.

Free Starter months and Partner conditions. When a Partner is approved, Pluff gives the Partner 6 or 12 months of the Starter plan free (chosen at approval). The free months are applied to the Partner's own plan subscription as a discount equal to the Starter plan's price: the Starter monthly price off each monthly payment during the free months, or, on yearly billing, the matching share of the Starter yearly price off the next yearly payment. They do not cover any higher plan: a Partner on Pro or Studio pays the difference between that plan's price and the Starter price. If the Partner has no plan subscription when approved, the free months apply when they start one. An application made during a free trial is decided before the trial ends where possible; if a decision comes after billing has started, the free months apply from the next payment and earlier payments are not refunded. After the free months, normal billing resumes on the payment method on file at the Partner's then-current plan price; Pluff emails the Partner about 7 days before billing resumes. As conditions of the partnership, Partners agree to keep their Pluff page link in their social bios, to keep their referral link on their Pluff page (it is added at approval and Pluff keeps it there while the partnership is active), and to disclose the partnership whenever they promote Pluff.

Referrals. A referral is a new Pluff account created within 60 days after that person last opened a Partner's referral link in the same browser (tracked with a first-party cookie described in our Cookie Policy). If someone opened more than one Partner's link, the last link opened before they created their account counts. An account can be referred only once, and only when it is created. Accounts belonging to the Partner, created by the Partner, or controlled by the Partner are not referrals.

Commission. For each referral, the Partner earns 30% of every Pluff plan payment the referred account actually pays (excluding taxes added on top, refunds and chargebacks) during the first 12 months after that account's first paid plan payment. Nothing is earned while the referred account is on a free trial, after it stops paying for a plan, on credit top-ups, or on sales the referred creator makes to their own buyers. Commissions are earned only while the Partner's partnership is active; payments made while a partnership is paused or ended earn nothing. Partners approved under the earlier Pluff Affiliate Program are on these same terms from October 27, 2026; commissions they earned before then keep the amounts they were earned at.

Holding period, refunds and payouts. Each commission is held for 30 days after the payment it comes from. If that payment is refunded or disputed, the matching share of the commission is cancelled, or, if it was already paid out, deducted from the Partner's next payouts. Commissions that have cleared the holding period are paid automatically once a month by bank transfer through Stripe, our payment processor, when at least $25 is ready; smaller balances roll over to the next month. Partners must complete Stripe's payout onboarding before they can be paid (commissions keep accruing in the meantime) and must provide tax information (such as IRS Form W-9 or W-8BEN) on request before any payout; Pluff may hold payouts until it is received. Partners are responsible for their own taxes.

Rules. Partners must clearly disclose that they earn a commission whenever they share their link (for example "#ad" or "affiliate link"), as the FTC Endorsement Guides and similar laws require. Partners may not: refer themselves or accounts they control; send spam or unsolicited messages; post on coupon, deal, cashback or incentivized-traffic sites; offer money or rewards for signing up; bid on or run ads using "Pluff" or similar terms; register domains, handles or pages that include "Pluff"; impersonate Pluff or suggest they speak for it; make false or misleading claims about Pluff, including promises of income or results; or use fake accounts, cookie stuffing or any other deceptive method to create referrals.

Changes and ending. Pluff may change the Partner Program, including rates and terms for future payments, with notice posted on the program page or sent by email; commissions already earned are not reduced by later changes. Either Pluff or the Partner may end the partnership at any time. If a Partner breaks these rules or acts fraudulently, Pluff may end the partnership immediately and cancel commissions that have not been paid, and may recover commissions paid for referrals obtained in breach of these rules. Otherwise, commissions earned before the partnership ends are paid once they clear the holding period.

Brand use. Partners may use Pluff's name and logo only to promote Pluff through their referral link, in a way that does not suggest Pluff sponsors or endorses them beyond the partnership. Pluff's liability to a Partner in connection with the Partner Program is limited to unpaid commissions properly earned under this section.

41. Connected AI Apps

A Creator on a plan that includes Pluff's AI features (every plan except Basic) may connect an AI app or agent of their choice (for example Claude, ChatGPT, Cursor or Codex) to their account through Pluff's MCP connector, by signing in from that app or with a personal token created in Settings → Connected AI apps. The Creator chooses what each connection may do. Everything a connected app does is done on the Creator's behalf and under the Creator's account: the Creator is responsible for it as if they had done it themselves — including what it publishes, posts, messages, approves or changes, and any AI credits it uses — and for reviewing its work. Some actions remain available only to the Creator inside Pluff (such as connecting a bank, plans and credit purchases, refunds, cancelling memberships, sending email campaigns, importing contacts, changing the handle or account email, connecting integrations, deleting products or the account, and exporting data).

Creators must keep tokens secret, connect only apps they trust, and revoke any connection they no longer use or suspect is misused. A connected app may use only the documented connector, within the permissions granted, and must follow these Terms, including Acceptable Use. Pluff applies rate and daily limits, may ask for confirmation before some actions, and may limit, suspend or revoke any connection, token or app (for example for abuse, security risk or excessive load), with or without notice. Connected apps are third-party services: their providers' terms and privacy policies apply to what they receive, and Pluff is not responsible for their output, availability or actions.
